Utah First Offense DUI: Charges, Penalties, & What the Law Requires

Under Utah Code 41-6A-502, a DUI occurs when a driver operates a vehicle with a blood alcohol concentration (BAC) of .05% or higher, or while impaired by alcohol, drugs, or any combination. Utah’s .05% BAC threshold is the strictest in the country. Impairment alone is sufficient for a charge, which means prescription drugs or a BAC just below .05% can still support a DUI arrest.

Class B vs. Class A Misdemeanor Classification

Most first-offense DUI charges are filed as a Class B misdemeanor under Utah Code 41-6A-503. Minimum penalties include 48 consecutive hours in jail (or an equivalent in compensatory service or home confinement with electronic monitoring), a minimum $700 fine plus court surcharges, a 120-day license suspension, mandatory screening and assessment, and supervised probation. The court may also order an ignition interlock device (IID), a breathalyzer wired to the vehicle’s ignition that prevents the car from starting if alcohol is detected.

The charge escalates to a Class A misdemeanor if bodily injury resulted, if a passenger under age 16 was present, or if the driver was 21 or older with a passenger under 18. A Class A conviction carries up to 364 days in jail and fines up to $2,500. If BAC tested at .16% or higher, the court must order treatment and an ignition interlock device or home confinement with electronic monitoring, and may impose additional license suspension at its discretion.

One consequence that affects nearly every first-time offender: a first-offense DUI conviction can’t be expunged from a Utah record until 10 years after the conviction is complete, including any probation or jail sentence, creating lasting exposure on background checks for employment and professional licensing.

The 10-Day DLD Deadline & Two Parallel Proceedings

A DUI arrest in Salt Lake City immediately activates two separate processes. The criminal case proceeds through either Salt Lake City Justice Court or the Third District Court, depending on charge severity. At the same time, the Utah Driver License Division (DLD) initiates an administrative license suspension that runs independently of the criminal case.

Drivers have only 10 calendar days from the date of arrest to request a DLD hearing to contest that suspension. Missing the deadline means automatic license suspension: 120 days for a first offense. Salt Lake City courts move DUI cases through arraignment and pretrial hearings on a defined schedule, so waiting to consult an attorney compresses the time available to investigate the arrest, gather evidence, and prepare challenges before early deadlines pass.

• Validity of the traffic stop: An officer must have reasonable suspicion of a traffic violation to initiate a stop. Evidence gathered from a stop that didn’t meet that standard may be subject to challenge.
• Field sobriety test administration: Standardized field sobriety tests must be administered according to defined procedures. Deviations in how they were conducted can affect their reliability as evidence.
• Breathalyzer and blood test accuracy: Chemical test results can be challenged on the basis of device calibration records, administration procedures, or breaks in the chain of custody for blood samples.
